TERMS OF SERVICE

1. ACCEPTANCE OF TERMS

By accessing or using the Syntax platform ("Service"), provided by Atomic Error ("Company," "we," "us"), you agree to be bound by these Terms. If you are entering into this agreement on behalf of a company, you represent that you have the authority to bind that entity. If you do not agree, do not initialise the Service.

2. THE SERVICE

Syntax is an AI-powered development environment designed to assist in the generation, modification, and deployment of software code.

AI Nature: You acknowledge that the Service uses artificial intelligence. Output generated by the Service ("Output") is probabilistic and may contain errors, bugs, or inefficiencies. You agree that you are solely responsible for reviewing, testing, and debugging any Output before deployment. The Service provides the bricks; you are the Architect.

3. INTELLECTUAL PROPERTY & OWNERSHIP

We do not claim ownership over what you build.

Your Input: You retain all rights to the code, prompts, and data you input into the Service ("Input").

Your Output: Subject to your compliance with these Terms, Atomic Error hereby assigns to you all right, title, and interest in and to the Output generated by the Service based on your Input.

No Training on Private Data: As per our Privacy Policy, we do not use your Input or Output from "Private" or "Enterprise" plans to train our general foundation models without your explicit consent.

4. USER RESPONSIBILITIES (THE "SUDO" CLAUSE)

You are responsible for all activity that occurs under your account.

Security: You must maintain the security of your credentials.

Compliance: You are responsible for ensuring that your use of the Output does not violate any laws or third-party rights (including open-source licenses).

Prohibited Use: You may not use the Service to generate malware, viruses, spyware, or any code intended to disrupt or harm systems. You may not reverse engineer or attempt to extract the underlying weights of the AI models.

5. PAYMENT AND SUBSCRIPTION

Fees: Services are billed in advance on a subscription basis (Monthly or Yearly).

Cancellation: You may cancel at any time. Access will continue until the end of the current billing cycle.

Refunds: Due to the high compute costs associated with AI generation, we do not offer refunds for partial months or unused "credits" unless required by law.

6. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED "AS IS." TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATOMIC ERROR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

SPECIFIC AI DISCLAIMER: WE DO NOT GUARANTEE THAT THE CODE GENERATED WILL BE ERROR-FREE, SECURE, OR BUG-FREE. YOU ACCEPT THAT USING GENERATIVE AI INVOLVES RISKS OF "HALLUCINATIONS" (INACCURATE OUTPUTS). YOU ARE RESPONSIBLE FOR VERIFYING THE OUTPUT OF THE AI MODELS.

7. LIMITATION OF LIABILITY

IN NO EVENT SHALL ATOMIC ERROR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS INTERRUPTION) ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

8. TERMINATION

We reserve the right to suspend or terminate your access immediately, without notice, if you violate these Terms, specifically regarding Section 4 (Prohibited Use).

9. GOVERNING LAW

These Terms shall be governed by the laws of The Netherlands, without regard to its conflict of law provisions.
